Someone leaked that SCOTUS Justice Stephen Breyer is about to retire. That means that Joe is going to get to nominate a Supreme Court justice to fill his seat.
Unfortunately, it looks like Brandon is focusing more on diversity than merit, as if that worked well with his horrendous VP, Kamala Harris.
She, you will remember, was only chosen because Biden foolishly pledged that he’d choose a black woman to be his VP, only to then find out that he had no good choices and had to go with Kamala.
Now he’s making that same pledge, saying that he’ll nominate a black woman to fill Breyer’s seat. The problem, outside of the diversity rather than merit issue, is that he literally has nine to choose from if he follows the recent trend of appointing younger (under 55 years old) judges. As NBC reports:
There are only nine Democratic-appointed black women on the federal bench younger than 55 this year. All are district court judges picked by President Barack Obama. The youngest is Leslie Abrams Gardner, 45, the sister of Biden vice presidential contender Stacey Abrams. Another name that stands out is Ketanji Brown Jackson, 49, a judge in Washington who was on Obama’s Supreme Court shortlist in 2016.
So, Biden has once again boxed him into a corner by pledging to rank diversity over merit in his nomination choices. That’s going to be a problem for him.
More importantly, it’s simply wrong. We’re supposed to focus on merit and the content of one’s character in America, not their skin color.
Tucker Carlson was quick to point that out on his program, saying that the promise was “patronizing” and hilariously asking:
“Where is Biden’s Pacific Islander nominee? Why isn’t there an American Indian on the court? Or a genderqueer? Or someone from the chronic fatigue syndrome community or a justice with cognitive disabilities? Why isn’t there an Afghan refugee under consideration?”
Indeed. Once people are chosen purely because of skin tone, gender, and ethnicity, doesn’t there have to be at least one of each type? Perhaps we can expand the court to include a proportionate number of each and every type of person in America.
Tucker then ended his monologue hilariously, saying that Biden should make the “obvious” choice and nominate George Floyd’s sister, Bridget Floyd, to fill Breyer’s seat. In his words:
“She is not a judge or a lawyer or whatever, but in this case, who cares? Clearly, that’s not the point anymore – this law stuff.”

Tucker is unfortunately correct on this point. Though Bridget Floyd won’t be nominated, she might as well be. The focus, from the left, at least, is now clearly on skin color, not merit. Brandon is looking for a black woman to drop into SCOTUS, not someone who will be a great legal mind. In Joe Biden’s American, diversity has replaced merit, even in the highest court in the land.
