Some of the top Republicans in the House think they’ve found a way to strike at Biden’s disastrous border policies in an effective way: they’re going to impeach Alejandro Nicholas Mayorkas, Secretary of Homeland Security, for “high crimes and misdemeanors.”
In fact, they’ve already written a resolution, H. RES. 582, to get the process for that going and start the impeachment ball. The resolution, describing in some of its early text why Mayorkas needs to impeached, accuses him of not doing his duty to defend and control the border, saying:
Alejandro Nicholas Mayorkas, in his conduct while Secretary of Homeland Security, engaged in a pattern of conduct that is incompatible with his duties as an Officer of the United States, as follows:
Secretary Mayorkas took an oath to defend and secure our country and uphold the Constitution when he was sworn in as Secretary of Homeland Security on February 2, 2021. Article II of the U.S. Constitution tasks the Executive branch—which today includes the Secretary of Homeland Security—with ensuring the laws passed by Congress and signed into law by the President are faithfully executed.
Secretary Mayorkas has failed to faithfully uphold his oath and has instead presided over a reckless abandonment of border security and immigration enforcement, at the expense of the Constitution and the security of the United States. Secretary Mayorkas has violated, and continues to violate, this requirement by failing to maintain operational control of the border and releasing hundreds of thousands of illegal aliens into the interior of the United States.
Secretary Mayorkas has willfully refused to maintain operational control of the border as required by the Secure Fence Act of 2006. His actions have directly led to an increase in illegal aliens and illegal narcotics, including deadly fentanyl, entering the United States.
That’s putting it quite bluntly: the team who wrote it isn’t dancing around the subject but rather means business and is openly accusing him of dereliction of duty.
Axios, reporting on how strong of a measure the resolution is, notes that “Only one Cabinet official has ever been impeached, according to the House historian.” That was a corruption-related dispute that took place during the Gilded Age.
And though the letter, written by Rep. Biggs, puts things so bluntly and leaves little room for compromise, 38 Republicans have co-sponsored it, ready to do what they see as their duty and stop Mayorkas from leaving the border open to illegal immigrant invasion.
McCarthy, however, left some room for compromise when speaking at the border in a press conference, saying “if someone is derelict in their job, there is always the option of impeaching somebody. But right now, he’s got 30 days.”
And while the resolution currently only has 38 co-sponsors, it could rally a good bit of GOP support: a letter recently sent to Mayorkas garnered 133 GOP signatures and it essentially made the same dereliction of duty claim, saying:
As you’ll notice, the reps make a similar argument that Mayorkas has so far disregarded the law in leaving the border open to invasion.
So, if he doesn’t change course and respond satisfactorily in the timeline given him by McCarthy, perhaps the resolution will pick up steam and lead to his ouster. Time will tell.
