Former President Donald Trump’s legal team has escalated efforts to challenge Fulton County District Attorney Fani Willis’ involvement in the case against him. They filed an appeal against a ruling permitting Willis to continue overseeing the Georgia election interference case, highlighting the intense legal battle and polarized political environment surrounding the proceedings.
The appeal, filed with the Georgia Court of Appeals, challenges a previous decision by Judge Scott McAfee, arguing that it contained errors by not requiring Willis’ disqualification from the case. The 51-page appeal document vehemently contends that this oversight constitutes a “legal error” requiring immediate judicial review.
Joined by notable figures such as Michael Roman, Rudy Giuliani, Mark Meadows, and Jeffrey Clark, Trump seeks to have the Fulton County indictment dismissed and Willis, along with her entire office, removed from the case.
The appeal comes after lead prosecutor Nathan Wade resigned due to controversies surrounding his romantic relationship with Willis. Now, a three-judge panel from the Georgia Court of Appeals will review the appeal, with one judge’s affirmative vote sufficient to advance it.
The defense’s filing argues against Judge McAfee’s determination, contending that existing case law required not only Wade’s disqualification but also Willis’s and her entire office’s removal, citing “plain legal error.”
Despite the ongoing appeal, Trump and his co-defendants maintain their not-guilty pleas to charges related to alleged efforts to overturn the 2020 election results in Georgia.
