By August 13, the agency escalated its actions by issuing a provisional notice, threatening to impose a hefty fine on 4chan if it did not comply. The fines were set even as 4chan’s legal representatives mounted a fierce defense against what they deemed foreign interference.
The response from 4chan was unequivocal. Their attorneys emphasized that the platform is a United States entity, incorporated in Delaware, with no assets or operations in the UK. They made it clear that any attempt to enforce penalties would be challenged in U.S. federal court. “Any attempt to impose or enforce a penalty against 4chan will be resisted in U.S. federal court,” the statement reads, underscoring the conviction that American rights do not capitulate to foreign directives.
Preston Byrne, one of the attorneys representing 4chan, reinforced this stance through a series of posts on X, emphasizing the legal grounds for American businesses to resist foreign overreach: “The UK government should now understand that any attempt to touch any American company, however small, will be met with a coordinated U.S. legal response.” His remarks imply a warning that such actions could backfire on UK authorities.
