Smith’s troubles stem from his management of two prosecutions against Trump that were ultimately dropped following the president’s win in the November election. As the DOJ investigates whether these cases were driven by a political agenda, Smith has sought refuge behind his legal team. He maintains that he adhered strictly to established protocols, a claim that has drawn skepticism from many observers.
According to reports from major media outlets, including Fox News and ABC News, Smith’s attorneys—Lanny Breuer and Peter Koski from Covington and Burling—wrote an emphatic letter in response to the investigation. In their correspondence to acting Office of Special Counsel (OSC) Jamieson Greer, the lawyers characterized the basis for the inquiry as “imaginary and unfounded.” They argue that Smith’s actions were guided solely by evidence and that he faithfully practiced DOJ guidelines throughout his tenure.
The attorneys declared, “Mr. Smith was fiercely committed to making prosecutorial decisions based solely on the evidence,” contending that his work was free from any electoral influence. Their letter went so far as to describe the investigation of Smith as the product of partisanship, thus diverting attention from their client’s past performance in prosecutorial duties. They claimed that the inquiry was “premised on a partisan complaint” and demanded robust engagement should the investigation proceed further.
Adding fuel to the fire, Sen. Tom Cotton (R-AR) has expressed concern. In a letter he wrote, he accused Smith of attempting to manipulate the upcoming 2024 election outcomes, suggesting that his legal maneuverings lack genuine foundation aside from political strategy. Cotton asserted, “Many of Smith’s legal actions seem to have no rationale except for an attempt to affect the 2024 election results… actions that would violate federal law.”
