North Carolinians deserve better.” He spearheaded a letter urging for Stokes’s removal under North Carolina General Statute § 7A-173(a), which allows for the removal of a magistrate who fails to perform their duties or conducts themselves in a manner that brings disrepute to the judicial office.
In their correspondence, the GOP lawmakers pointed out that her actions clearly qualify as both grounds for dismissal. “Magistrate Stokes’s actions in the case of Decarlos Brown, Jr. clearly meet both of these grounds for removal,” they asserted, emphasizing the dangerous precedent set by her leniency.
The response from Chief District Court Judge Roy Wiggins has drawn criticism as lacking substance. His letter expressed sadness regarding Zarutska’s death, but it failed to directly address the concerns raised about Stokes’s judgment. Instead, Wiggins stated he would review local bond policies and engage in educational efforts for magistrates about assessing the risks associated with pretrial release. His vague assurances raised more eyebrows than confidence.
Rep. Mark Harris (R-NC), another supporter of the removal effort, did not hold back in expressing his frustration on social media. He shared Wiggins’s statement and remarked pointedly about the situation, questioning Stokes’s ability to serve effectively when, according to him, she has “lost the public’s confidence.” He added, “The District Court says they are ‘reviewing’ and ‘evaluating’ policies and procedures. But is Stokes still making judgments for other criminals?” This sentiment highlights a growing concern among constituents regarding judicial accountability and the implications of such decisions on community safety.
