Lydia and Heath Marvin, a Christian couple from Woburn, Massachusetts, recently lost their foster care license after refusing to comply with the state’s LGBTQIA+ affirmation policy. This policy mandates that foster parents must “affirm” a child’s declared LGBTQIA+ identity, placing their deeply held religious beliefs in direct opposition to state requirements.

Since 2020, the Marvins have opened their home to eight foster children, including a medically fragile infant who stayed with them for 15 months. Their Christian faith has guided their efforts in nurturing and caring for these vulnerable children. “Our Christian faith really drives us toward that. James says that true undefiled religion is to care for the fatherless,” Heath shared in an interview. This commitment to their faith makes their situation even more poignant.

In April, the Massachusetts Department of Children and Families (DCF) revoked their foster license after the couple refused to sign the LGBTQIA+ Non-Discrimination Policy introduced in 2022. Among other things, this policy requires foster parents to support the gender identities claimed by children, use chosen pronouns, and adopt gender-neutral practices. The Marvins sought alternatives, expressing their willingness to care for any child but recognizing they could not act against their religious convictions in this matter. “We asked, is there any sort of accommodation? Can you waive this at all? We will absolutely love and support and care for any child in our home, but we simply can’t agree to go against our Christian faith in this area,” Lydia recounted. Ultimately, they were left with no choice but to accept the state’s ultimatum.

Their appeal was denied, leading the couple to consider legal action. They have joined two other Christian foster families in a federal lawsuit against the DCF, backed by the Massachusetts Family Institute and the Alliance Defending Freedom. This case highlights a growing conflict between state mandates and religious freedom, particularly in the realm of child welfare.

The Trump administration has also weighed in on this issue, sending a letter to the DCF addressing the situation. “These policies and developments are deeply troubling, clearly contrary to the purpose of child welfare programs, and in direct violation of First Amendment protections,” wrote Andrew Gradison, Acting Assistant Secretary for the Administration for Children and Families. This statement raises important questions about the balance between protecting children and upholding the rights of parents, particularly those with religious convictions.

On the other side of the debate, LGBTQ+ advocates argue that the affirmation policy is designed to protect the welfare of LGBTQ+ youth. Polly Crozier, Director of Family Advocacy at GLBTQ Legal Advocates and Defenders, noted that foster parents are not the permanent guardians of these children, emphasizing the need for temporary care to ensure children can safely return to their families of origin. “The state has an obligation to children to make sure that they’re safe and well protected,” she said, framing the issue as a child safety concern.

The contention surrounding this case reflects broader debates about the intersection of personal beliefs and governmental policies in America. With approximately 30 percent of foster children in Massachusetts identifying as LGBTQ, the stakes are high for all involved. Data collection by the DCF remains inadequate, but reports indicate that similar percentages emerge in states like California and New York.

The Marvins’ experience illustrates a significant tension in modern fostering systems—between the need to protect individual identities and the rights of parents who may not share the same beliefs. As the couple searches for their next legal steps, they stand at the crossroads of a crucial debate that could shape the future of foster care and parental rights in the United States.
