Former special counsel prosecutor Jack Smith stands by his investigative decisions involving President Donald Trump, which he passionately defended during a recent appearance before the House Judiciary Committee. Smith emphasized that his team found “proof beyond a reasonable doubt” of Trump’s criminal conduct. He stated, “If asked whether to prosecute a former president based on the same facts today, I would do so—regardless of whether that president was a Republican or a Democrat.”

This marked Smith’s first public testimony regarding the dual investigations he led, which examined Trump’s purported attempts to undermine the 2020 election and his alleged mishandling of classified documents. Notably, he brought charges against Trump, which were later dropped after Trump’s re-election, in line with the Justice Department’s established policies.

Smith expressed no regrets about his tenure as special counsel, reaffirming that his actions were impartial and followed Justice Department guidelines. The atmosphere during the hearing grew heated as House Judiciary Chairman Jim Jordan, along with other Republicans, challenged Smith on some of his methods. A key point of contention was Smith’s decision to access “tolling records” of certain Republican lawmakers. These records include detailed phone logs, which Republicans criticized as an instance of “political weaponization.”

In response, Smith defended his approach, labeling the use of tolling records as “common practice” in investigations. He noted that the Public Integrity Section had approved the subpoenas, a claim backed by public records released earlier. Nonetheless, some Republicans characterized Smith’s tactics as overly aggressive and beyond his mandate. Representative Kevin Kiley from California accused Smith of seeking “maximum litigation advantage at every turn” while disregarding constitutional limitations.

Trump also weighed in during this time, speaking at the World Economic Forum. He claimed that “everybody now knows” the 2020 election was “rigged” and hinted at potential prosecutions of individuals involved, although he did not elaborate further.

Smith highlighted the integrity of the special counsel team, asserting that the investigators adhered strictly to legal standards. “We observed legal requirements and took actions based on the facts and the law,” he stated, emphasizing that political affiliations did not influence their decisions.

He spoke regretfully about the fallout from his investigations, particularly the ousting of FBI agents and Justice Department employees, including members of his own team. He condemned Trump’s actions, suggesting they were designed to intimidate “career prosecutors, FBI agents and support staff simply for having worked on these cases.” Smith remarked, “To vilify and seek retribution against these people is wrong. Those dedicated public servants are the best of us, and it has been a privilege to serve with them.” This sentiment underscores the challenges faced by law enforcement officials when their work comes under public scrutiny.

In the past months, many FBI personnel involved in the January 6 investigations faced new challenges, including a sweeping questionnaire that inquired about their roles in the investigation. Several individuals connected to these inquiries were terminated, actions that were reported as acts of “retaliation.” Smith underscored the impact of such personnel changes, stating, “In my opinion, these people are the best of public servants; our country owes them a debt of gratitude, and we are all less safe because many of these experienced and dedicated law enforcement professionals have been fired.”

As the investigations and their aftermath continue to unfold, Smith’s steadfast defense reflects a commitment to what he believes is the rule of law, regardless of political affiliation. His testimony not only highlights the complexities of investigating high-profile figures but also reveals the potential dangers faced by those who dedicate their careers to such critical public service.
