This commitment was highlighted by President Trump in a speech at the World Economic Forum, where he emphasized that foreign entities have been “screwing” American interests for far too long. While tariffs have gained much attention as a primary strategy, the administration is actively pursuing additional measures to protect U.S. companies and their intellectual property.

Tariffs have been the focus of many discussions, framed as a means to bring back supply chains and boost job creation. However, there is more beneath the surface. The administration is working to reinforce protections for American intellectual property (IP)—an essential component for fostering innovation and economic progress. Countries that neglect or weaken these protections pose a significant threat to American industries, particularly those heavily invested in research and development, such as pharmaceuticals.

The pharmaceutical industry serves as a prime example of how foreign governments engage in practices that undermine U.S. innovation. American firms lead the way in drug development, yet they face challenges from foreign price controls and regulatory hurdles designed to suppress the costs of American-made medicines. This creates an imbalanced burden that mainly falls on American patients, who ultimately pay the price for these unjust practices.

The European Union has introduced changes in its pharmaceutical regulations that cut the market exclusivity period for new drugs. Additionally, there are moves to facilitate government access to patented technologies. Such measures can diminish the incentive for innovation and investment, which could have ripple effects on employment and economic growth.

Furthermore, Mexico has yet to meet its commitments under the United States-Mexico-Canada Agreement (USMCA). Early launches of generic products in Mexico restrict American biotech firms’ ability to protect their patents. The U.S. must maintain pressure on Mexico to ensure compliance with its trade obligations.

Recent deals, like the one with the UK, show proactive efforts to balance trade relationships while safeguarding U.S. interests. By linking tariff exemptions to requirements around biotech spending, the administration is attempting to create more favorable conditions for American firms abroad.

The issue of patent infringement is also being addressed by the administration. The Department of Justice and the U.S. Patent and Trademark Office are taking steps to prevent the importing of products that violate American IP rights. Their involvement in current legal cases against companies like Samsung underscores a dedication to protecting innovative startups from irreversible harm caused by theft of technology.

The administration could take further action by advocating for legislation such as the RESTORE Patent Rights Act, aimed at enhancing courts’ ability to grant injunctions in patent disputes. Adding the EU to the Special 301 watchlist could also send a strong message about their trade practices.

While tariffs dominate headlines, the comprehensive strategy to defend American intellectual property may ultimately reshape global trade dynamics. Strengthening and enforcing these protections is crucial for maintaining a competitive edge for American innovators and workers. As these efforts continue, the long-term benefits could far outweigh the immediate impacts of more visible tariff policies.
