A California judge has dismissed the final charge against David Daleiden, a pro-life activist, closing a contentious chapter featuring allegations of illegal profit from fetal tissue by abortion providers. Daleiden, the founder of the Center for Medical Progress, tweeted about the victory, stating, “As promised, the final charge has been DISMISSED and the case completely expunged.” This statement reflects a culmination of legal battles stemming from a 2017 investigation initiated under former California Attorney General Kamala Harris.

The legal saga began when Daleiden and journalist Sandra Merritt released undercover videos in 2015, alleging that Planned Parenthood was profiting from fetal tissue sales. These recordings prompted significant controversy and triggered state investigations. Despite Daleiden and Merritt facing 15 charges, the last remaining charge has now been cleared.

In January 2025, both activists pleaded no contest in a settlement allowing them to avoid jail time, fines, or any admission of wrongdoing. Judge Brian Ferrall’s dismissal comes after months of administrative delays and what Daleiden described as a “bizarre last-minute ‘April Fool’s'” attempt from Planned Parenthood and the National Abortion Federation to overturn the state’s agreement.

Following the dismissal, Daleiden expressed that the end of “the lawfare launched by Kamala Harris” is a significant victory for his investigative work. He maintained that exposing what he considers the truth about Planned Parenthood’s practices is essential for public knowledge. The videos released in 2015 depicted conversations with Planned Parenthood officials and abortion doctors discussing methods to keep fetal organs intact for potential harvesting.

The case has painted a complicated picture of the ongoing battle between pro-life and pro-choice advocates. In stark contrast to Daleiden’s perspective, California Attorney General Rob Bonta framed the plea deal as a win for access to reproductive healthcare. Bonta emphasized that securing felony convictions is vital to protect Californians’ constitutional rights regarding reproductive services.

Under the terms of the deal, Daleiden and Merritt must avoid contact with the individuals recorded and adhere to laws that prevent unlawful recordings in the future. The legal tension was compounded by a larger narrative surrounding reproductive rights, with Bonta highlighting ongoing efforts to challenge those who threaten access to abortion.

In an interesting turn, the release of Daleiden’s videos led to broader inquiries about Planned Parenthood, but ultimately, no charges were ever filed against the organization. Conversely, Daleiden faced backlash when Planned Parenthood sued him, resulting in a ruling that imposed $2.4 million in damages alongside over $13 million in attorney’s fees.
