Democrats in Nevada are gearing up for a legal battle over the proposed SAVE America Act, if it clears the Senate and gets President Trump’s signature. This legislation focuses on strengthening voting laws by blocking noncitizens from voting, requiring in-person registration, and mandating documents like birth certificates to prove citizenship for voter registration. It also aims to purge voter rolls and enforce strict voter ID measures.

Democratic Secretary of State Francisco Aguilar expressed his skepticism about the law, stating, “Noncitizens voting in Nevada is not an issue.” He believes the narrative surrounding illegal voting is a tactic used by the Trump administration to instill fear and deter participation in elections. Aguilar emphasized that Nevada already has mechanisms in place to remove illegals from voter registration lists. However, Trump and many Republicans argue that states are failing to adequately secure elections.

Aguilar declared, “We’re going to fight it,” signaling preparations for litigation against the bill to delay its implementation. He noted that the intent behind this delay is to ensure the elections are fair and that voters can participate without fear. He also pointed out that misinformation has already caused confusion among voters, prompting fears over registration requirements.

Despite the pushback from Democrats, public support for election integrity measures remains robust. A Pew Research Center survey from August 2025 revealed that 83% of Americans, including a significant 71% of Democrats, favor requiring government-issued photo ID to vote. This suggests that concerns over election security resonate with a large portion of the American public, cutting across party lines.

The SAVE America Act narrowly passed in the Republican-controlled House earlier this year, with a vote tally of 218-213, aided by a lone Democratic vote. It currently awaits action in the Senate, where Trump has been urging Senate Majority Leader John Thune to abolish the filibuster. Such a move would allow Republicans to pass the legislation with a simple majority of 51 votes, rather than the 60 typically needed to overcome a filibuster.

There has been recent discussion about bringing the bill to a Senate vote, which could force Democrats into a “talking filibuster” situation, requiring them to continuously speak and hold the floor. However, plans to advance the bill have stalled amid rising tensions due to the Iran conflict. Trump asserted that it is Thune’s responsibility to gather support for the bill, insisting, “He’s got to be a leader.”

In another development, Trump signed an executive order aimed at enhancing mail-in voting security, which sparked opposition. Officials from 23 Democratic states, alongside the District of Columbia, filed a lawsuit to challenge this order, categorizing it as unconstitutional. The litigation, primarily led by California, has been initiated in a U.S. district court in Massachusetts.

Republican Senator John Cornyn of Texas, facing his own challenges in a primary battle, has advocated for dismantling the filibuster in light of the current political landscape. He criticized Democrats for their tactics and mentioned attempts made by their leaders to eliminate the filibuster in previous election cycles. “When the reality on the ground changes, leaders must take stock and adapt,” he argued, pointing out a growing necessity to adapt Senate rules.

With tensions brewing and legal battles looming, the shaping of voting laws in America remains a contentious and pivotal issue as the political landscape evolves.
