Reports state that Barbosa, originally in the U.S. as an au pair, was employed by Swalwell’s campaign. Initially paid $3,914 in late 2021, her compensation ballooned to nearly $47,000 in 2022 before payments ceased in 2023 and 2024. The congressman appears to have reimbursed himself for over $52,000 in childcare expenses during that same period, suggesting a deliberate attempt to evade legal scrutiny.

Critics argue that Swalwell’s actions indicate an awareness of the illegality of employing Barbosa, as his campaign halted payments once she was unauthorized to work in the U.S. Allegations of financial impropriety with campaign funds could have severe legal ramifications.

Both CNN and the San Francisco Chronicle have reported investigations by the Manhattan District Attorney’s office into allegations made by former staff and multiple women. Eric Daugherty summed up the situation: “As if it couldn’t get any worse for Eric Swalwell: He is now accused of violating immigration and employment law to keep an illegal alien nanny from Brazil in America.” Daugherty claims Swalwell paid Barbosa under the table for two years when she lacked valid work authorization.
