House Republicans are raising serious alarm bells regarding the potential exploitation of U.S. birthright citizenship and visa programs by China. In a letter sent to key members of the Trump administration, including the outgoing Homeland Security Secretary Kristi Noem, they highlight how policies in the Commonwealth of the Northern Mariana Islands could be manipulated to expand Chinese influence within the United States.

Representatives Chip Roy from Texas and Tom Tiffany from Wisconsin, along with 32 other GOP colleagues, emphasize the threat posed by “birth tourism.” This practice involves foreign nationals, particularly from China, traveling to U.S. territory to give birth so their children can obtain American citizenship. Roy described American citizenship as a “sacred trust” and voiced concerns that adversaries like the Chinese Communist Party could exploit loopholes for their gain. “When foreign adversaries like the Chinese Communist Party can leverage birth tourism and visa-less programs to gain influence within our borders, we must restore integrity to our immigration system and defend the sovereignty of our Republic,” he stated.

Tiffany backed these assertions, noting the phenomenon where Chinese women travel to the Northern Mariana Islands specifically to give birth for citizenship purposes. He called for an end to these loopholes to ensure national security is protected. The current immigration landscape allows for such practices, thanks in part to historical and ongoing policies that have created unique pathways for certain Chinese nationals to enter the U.S. without a traditional visa.

The lawmakers pointed out that under the 14th Amendment, children born on U.S. soil are granted citizenship. This includes births in the Northern Mariana Islands, which operates under distinct immigration rules. Various reports suggest that a significant number of Chinese nationals—estimates range from 750,000 to 1.5 million—have potentially gained citizenship through these means. However, these figures remain unverified by federal agencies.

As part of their inquiry, Roy and Tiffany seek data from the Departments of Homeland Security, State, and Interior about births since 2009 to at least one Chinese national parent, their voting status, and any connections to the Chinese Communist Party. They are particularly concerned about how large-scale immigration through these means could affect U.S. elections, raising questions about whether such citizens might become registered voters.

This scrutiny follows several criminal cases against individuals involved in organized birth tourism, particularly in California, where prosecution has occurred for visa fraud and conspiracy stemming from these operations. In tandem, the Northern Mariana Islands historically established differing immigration practices. A part of this was the introduction of a categorical parole program in 2009, initiated by the Obama administration, allowing select Chinese nationals entry without traditional visa requirements. The current Biden administration has continued this trend by finalizing a rule that enables certain Chinese nationals to visit the territory without a visa for short durations.

The lawmakers warn that citizenship granted to children born in the U.S. can lead to additional immigration pathways. As they turn 21, these citizens can sponsor their parents for lawful permanent residency. This aspect poses a concern for the lawmakers, especially considering ongoing tensions with China. They have pressed the administration to end any programs that extend such privileges to Chinese nationals in the Northern Mariana Islands, while also calling for clarity regarding the extent of birth tourism related to Chinese nationals.

As yet, there has been no response from the Departments involved, leaving the situation open-ended. The letter underscores a growing apprehension about Chinese influence within American borders, a topic that is becoming increasingly critical in discussions surrounding national security. A quick response from the Chinese embassy remains unrecorded, further complicating the narrative surrounding this issue.
