Indiana is taking a significant step in tackling illegal immigration with the signing of Senate Enrolled Act 76 by Governor Mike Braun. This new law empowers Attorney General Todd Rokita to impose penalties on sanctuary cities, counties, hospitals, and state-funded educational institutions that do not cooperate with federal immigration authorities.
Rokita made his views clear on social media, emphasizing the illegality of sanctuary jurisdictions. He stated, “Sanctuary jurisdictions are unlawful,” highlighting the urgent need for Indiana to address the issue of employers hiring illegal aliens. His unequivocal stance reflects a broader commitment to enforcing immigration laws in the state. “It’s long past time Indiana crack down on employers and local governments who act as magnets for criminals,” he added.
The legislation effectively mandates that schools, hospitals, and local governments facilitate cooperation with federal immigration officials. No longer can these entities hide behind unofficial policies designed to obstruct such cooperation. It also places a significant burden on local law enforcement to engage actively with immigration enforcement agencies.
Penalties for employers who hire illegal immigrants are also set to rise, reinforcing the message that Indiana will not tolerate noncompliance with immigration laws. Rokita noted that this law would aid local law enforcement significantly in their efforts to “remove criminal illegal aliens from our communities”—a strong statement that underscores the state’s focus on safety.
The bill’s origins date back to a troubling incident in January 2025, which highlighted the challenges faced when local institutions resist federal immigration enforcement. Agents from Immigration and Customs Enforcement attempted to apprehend a Honduran man and his child, who was a student at Indianapolis Public Schools (IPS). When IPS refused to assist ICE without a court order, it raised alarms for Rokita. While IPS later modified its policy following an investigative demand, Rokita remained concerned about the resistance to immigration enforcement.
This new law serves as a response not only to past incidents but also as a preventative measure against future noncompliance. Rokita’s office is already prepared to target entities that continue to defy the legislative intent regarding cooperation with federal authorities. His office also stated that SEA 76 adds clarity to the Indiana Code, making it actionable against local government restrictions hindering communication with federal agents.
As Rokita presses forward, he has pending cases against Monroe County Sheriff Ruben Marte and St. Joseph County Sheriff Bill Redman, alleging similar violations of the state’s anti-sanctuary city laws.
