Late December 22nd, 2021, The Daily Wire received word that their motion to challenge the Biden Test or Vaccine Mandates for private companies would be heard by the Supreme Court of the United States of America. Their oral arguments are scheduled to begin January 7th, 2022. Said arguments will be heard by Supreme Court Justice Brett Kavanaugh, and may only last up to an hour in length.
It all began on September 9th, 2021, when Biden ordered OSHA to require a vaccine or test mandate on all business in the private sector that had 100 or more employees working for them. This, of course, came after Biden initially said that he would not require or mandate vaccines on all Americans back on December 4th, 2020.

There’s the video. There’s no way to misinterpret, misinform, or misunderstand. “No. I don’t think it should be mandatory, I wouldn’t demand it be mandatory. But I would do everything in my power, just like I don’t think masks should have to be made mandatory nationwide. I’ll do everything in my power as president of the United States to encourage people to do the right thing and when they do it, demonstrate that it matters,” Biden stated.
Ironically, he goes on to state that if people would just commit to wearing masks for 100 more days, we wouldn’t see hundreds of thousands of cases or deaths anymore.
So, in one video we have three lies. 1. He says vaccine mandates should not and would not be made mandatory. 2. He says wear your masks for one hundred more days, implying that’s all the time left to be wearing masks in order to get the vaccines distributed. (We saw how well that turned out) 3. He says that both cases and deaths will decline and drop off.
Back to September 9th of 2021, a mere 10 months later, Biden reversed his decision entirely. The Nation Law Review reported, “President Biden directed OSHA to issue a rule requiring private sector employers with 100 or more employees to mandate that employees either get an approved COVID-19 vaccination or produce a negative test on a weekly basis. In addition, the rule will require that these employers grant employees paid time off to get vaccinated and recover from any post-vaccination symptoms. OSHA will be issuing an Emergency Temporary Standard to implement these requirements.”
The Daily Wire was the first private company to file a suit against Biden’s mandate as they knew immediately that they had over 100 employees, some of which were not ever going to comply despite the fact that the founders of the company, Ben Shapiro and Jeremy Boreing, are both fully vaccinated.
As Boreing himself states, “This isn’t about whether or not the vaccine is safe or should be taken. It’s about the role the government has in our lives and just how much control we should allow them in our medical decisions.”

Receiving the news on the order today was no doubt a relief.
The Order says:
Consideration of the applications (21A244 and 21A247) for stay presented to Justice Kavanaugh and by him referred to the Court is deferred pending oral argument. The applications are consolidated, and a total of one hour is allotted for oral argument. The applications are set for oral argument on Friday, January 7, 2022.
Just prior to the news that SCOTUS would hear out The Daily Wire, Jeremy Boreing left the following statement.
“We are confident in our cause. We have the rule of law – administrative and constitutional – on our side. We have the science on our side. We have the best and most moral arguments on our side. … If the Supreme Court will hear our case, we will win. If they won’t, it won’t just be a loss for us at The Daily Wire, but for all Americans. It’s hard to claim to be a free country when you can force businesses to force their employees to either violate their own consciences and inject themselves with drugs they do not wish to take, be discriminated against, or be fired.”
