The legal team representing former President Donald Trump requested that the judge overseeing the case on Thursday to toss out the Washington federal election subversion case against their client, making the case he is immune from prosecution for the actions taken during his official role as president. And you can almost hear liberals all over the country seething through their teeth at the “audacity” of Trump to fight back against this particular indictment against him. After all, they are hanging all of their hopes on having the mountain of charges they have thrown at the former president remove him from the 2024 playing field.
“The motion amounts to the most pointed attack yet by defense lawyers on the federal case charging Trump with plotting to overturn the results of the 2020 presidential election he lost to Democrat Joe Biden. In it, they argue that the actions that form the basis of the indictment, including urging the Justice Department to investigate claims of voter fraud and pressing state officials on the administration of elections, cut to the core of Trump’s responsibilities as commander in chief,” Newsmax reported.
“Breaking 234 years of precedent, the incumbent administration has charged President Trump for acts that lie not just within the ‘outer perimeter,’ but at the heart of his official responsibilities as President,” the defense motion goes on to say. “In doing so, the prosecution does not, and cannot, argue that President Trump’s efforts to ensure election integrity, and to advocate for the same, were outside the scope of his duties.”
Defense attorneys have been sort of hinting at using the presidential immunity argument for a few weeks now, dropping clues here and there in statements that have been made as the various cases against Trump have moved forward. Special Counsel Jack Smith, the individual chosen by the deep state to weaponize federal law enforcement and the justice system as a whole in order to get Trump disqualified from running for president, seemingly anticipated the former president’s legal team using this particular argument, stating while presidential candidates are allowed to question losses, the actions taken by Trump went far beyond what they claim was legally permissible.
As you probably already guessed, prosecutors are going to contest the motion.
The reason these cases against Trump are so important is because the very rights protected in the Fifth and Sixth Amendments to the Constitution are currently under attack and if we fail to adequately protect them in the indictments against the former president, you can guarantee you’ll see liberals at all levels begin to weaponize the Justice Department against conservatives and other political enemies.
It’s already happening. How many pro-life advocates are now being persecuted by the legal system for doing their best to protect unborn human beings, our most vulnerable citizens, from having their basic right to life stripped away from them? It’s insane how common this is becoming.
It is critical to see Trump victorious in these four indictments, as the future of “innocent until proven guilty” could potentially hinge on their outcome.
