During a recent segment on MSNBC’s “Morning Joe” program, legal analyst Danny Cevallos darn near made the hosts’ heads explode when he asserted that illegal migrants are not entitled to due process under U.S. law. And as you might expect, the controversial statement immediately sparked a heated debate over constitutional rights and their application to immigration policy.
The remarks from Cevallos came during a conversation on the program concerning legal challenges about immigration enforcement. Cevallos argued that due process protections don’t extend to individuals who entered the U.S. illegally, going on to suggest the government has broader authority to detain and deport these folks without the same legal procedures that would be afforded to those who are citizens or legal residents.
Critics were quick to issue responses by tossing out references to both the Fifth and Fourteenth Amendments of the Constitution, which guarantee the right to due process to “persons,” not just citizens. Now, the only way to solve this is to do a little exegesis and study history to find the original intended meaning of these amendments.
Doing that kind of research will help us settle the matter definitively. The Left knows this won’t go in their favor, which is why they hate originalist justices in the Supreme Court. To them, the Constitution is a “living document,” which translates as our founding document’s meaning changing with the times.
Unfortunately, the whole “persons” interpretation by liberals has already been upheld in several court rulings, including a landmark SCOTUS case, Zadvydas v. Davis, which affirmed that non-citizens are entitled to certain constitutional protections. Which, of course, is wrong.

What the radical left doesn’t understand is that by providing illegal migrants with constitutional protections, they, as noncitizens, do not have a right to, law enforcement’s ability to enforce immigration laws will be severely hindered. And, of course, a lot of these individuals are members of cartels and violent gang members, which means if they are somehow let go through the process, our citizens could become victims of violent crimes.
Why are liberals going to bat for these criminals instead of looking for ways to protect the people of this country? Keep in mind that it was these same politicians, headed up by President Joe Biden, who are to blame for the border crisis President Donald Trump is now attempting to deal with.
They wanted illegal migrants to flood into the country because they planned to use them to fill out their voter rolls and win elections. As you can clearly see, they’re still fighting for this goal.
