Alan Dershowitz, a constitutional scholar, issued a prediction on Monday that Gov. Gavin Newsom’s lawsuit filed against President Donald Trump over the Los Angeles anti-ICE riots will crash and burn. Ironic choice of words, right?
During his program “The Dershow,” Dershowitz shared his doubt that the Supreme Court would “second guess” a decision by the president to federalize thousands of National Guardsmen and send them to the hottest spots for criminal activity in L.A.
Newsom filed a lawsuit against the president, leveling accusations at him of “unlawfully” taking over control of soldiers under his command and sending them out to stop the unrest.
“The Supreme Court will not second-guess the President of the United States on this issue,” Dershowitz said, according to Trending Politics News. “They will say, whether right or wrong, the president had the authority to make this decision and he had the authority to make it over the lack of consent of the governor,” Dershowitz continued.
“Let’s be clear, there was violence. You can see it on television; there were bombings, fire bombings, and burnings of Teslas and other self-driving cars. There were rocks being thrown at ICE officers. There were threats against ICE officers, threats against their families. Was it a full-blown insurrection? No.” He added.
In addition to 4,000 National Guard soldiers, Trump has sent 700 Marines to L.A. to end riots now in their fifth day after U.S. Customs and Immigration Enforcement officers arrested upward of 150 illegal immigrants over the weekend. The operation quickly drew protestors who morphed into rioters, hurling cinderblocks at ICE agents and smashing their way into stores while looting anything they could carry.
Bill Melugin of Fox News showed footage taken from inside one of the ICE vehicles that was pummeled by rocks over the weekend. In it, you can see the damage done by the rocks, which included a shattered windshield. An immigration official also said he sustained an injury during the attack.
Dershowitz predicted the high court would likely rule against Newsom and determine that President Trump was within his rights to activate the National Guard under the auspices of protecting civil rights.
“My prediction is: the lawsuits will fail. They’ll work in the federal district court,” Dershowitz further elaborated. “You’ll get, you know, the governor of California will find a federal district judge probably one he was involved in appointing and you’ll get some district court judge saying, maybe even issuing an injunction saying, the president of the United States can’t do this.”
“It’ll be appealed immediately, but when the case gets to the Supreme Court in the United States, they would have no choice or little choice, but to hold that the judiciary cannot interfere with the discretionary judgment of the executive head of the executive branch, the president, about the necessity for sending in troops,” Dershowitz concluded.
